Ticket Sales Terms and Conditions
Article 1: About These Terms of Use
- 1. These TOBE Ticket Sales Terms (hereinafter referred to as the "Terms") outline the methods of use for the ticket sales service provided by TOBE LIVE JAPAN Co., Ltd. (hereinafter referred to as "the Company") (hereinafter referred to as "the Service"). These Terms apply to all actions taken by users when utilizing the Service.
- 2. The Company may establish additional rules for using the Service, in addition to these Terms, which will be published on the Company's website. Regardless of their name, these rules are considered part of these Terms.
- 3. In the event of any discrepancies between the content of these Terms, the rules mentioned in the previous paragraph, and any other descriptions of the Service outside these Terms, the provisions of these Terms shall take precedence.
- 4. By using the Service, users are deemed to have agreed to all the contents specified in these Terms. When using the Service, users must read the full text of these Terms and agree to them after confirming the cautionary notes displayed on the Service.
Article 2: Definitions
The definitions of terms used in these Terms, unless otherwise specified, are as follows:
- 1. "User" refers to individuals who use the Service through methods such as browsing, application, or purchase, and users with TOBE ID are referred to as "registered users."
- 2. "TOBE ID" refers to the ID issued to users registered on the artist fan club platform "TOBE COMMUNITY," operated by TOBE.
- 3. "Fan Club" refers to individual artist fan clubs operated by TOBE.
- 4. "User Information" includes information that users register at the time of TOBE ID registration, information users register when using the Service, and information obtained by the Company when providing the Service to users.
Article 3: Registration and ID
- 1. In order to use this service, a TOBE ID is required. If you do not have a TOBE ID, please register with TOBE COMMUNITY and obtain a TOBE ID.
- 2. Registered users must manage their ID, password, etc., carefully, and any expression of intent on the Service using these is considered valid on the part of the registered user.
- 3. Registered users are prohibited from transferring, lending, leasing, selling, or engaging in any similar activities regarding their account, ID, password, etc.
- 4. The Company may cancel the registration of a registered TOBE ID, suspend or delete the eligibility to use the service, or take any other necessary measures if any of the following reasons apply:
- ・If the user violates any of the terms of use or has previously violated them
- ・If a new membership application is made with an already registered ID or email address
- ・In case of double registration
- ・If the user does not exist
- ・In case of any deficiency in the application details
- ・If contact cannot be made
- ・If there is a rational basis to determine the likelihood of any of the above occurring
- ・If it is determined appropriate for the Company to cancel for any other reason
- 5. The handling of registered TOBE IDs shall be in accordance with the TOBE ID Terms of Use.
Article 4: Use by Minors
- 1. If a minor uses the Service, including applying for tickets or purchasing goods, which includes the use of paid services, the consent of the legal representative (such as a parent or guardian) is required.
- 2. If a minor uses the Service without the consent of the legal representative specified in these Terms, or falsely claims to have consent when there is none, or falsely claims to be of legal age when using the Service, the minor and their legal representative cannot cancel any legal actions taken in connection with the Service.
- 3. A user who was a minor at the time of agreeing to these Terms and later uses the Service upon reaching the age of majority is considered to have ratified all legal actions related to the use of the Service.
Article 5: Effects Resulting from Customer's Usage Environment
Our provided Services are intended for individuals whose settings, such as character display (Japanese language) and email, are appropriately configured. We bear no responsibility for the operational outcomes or resulting effects for those whose circumstances do not meet these criteria. Furthermore, even if the above conditions are met, in cases where our Service does not function correctly due to any and all factors related to the user's internet usage environment settings (including causes beyond our control), we shall not be held liable for any resulting effects
Article 6: Handling of Personal Information
The Company will handle user information in accordance with the separately posted"Privacy Policy".
Article 7: Determination of Ticket Sales Methods
- 1. For the sale of tickets, various restrictions and conditions may apply to the application, purchase, etc., depending on the performance for which you are applying. Users must comply with the information provided at the time of application.
- 2. Users are required to accept that the sale of tickets may be determined by lottery, including the determination of winning or losing results and seat locations.
Article 8: Ticket Application, Purchase, and Entry Tickets
- 1. Users of the Service must comply with the methods specified by the Company and follow the prescribed procedures for applying and purchasing tickets.
- 2. Tickets applied for and purchased through the Service cannot be changed or canceled after the application period has ended.
- 3. Users who have won in ticket purchases must make the payment for the ticket price within the designated period. Users who do not follow the prescribed procedures for application and purchase or who do not make the payment for the ticket price on multiple occasions may be subject to measures such as the suspension of the use of the Service.
- 4. The use of entry tickets must follow the methods specified by the Company for each performance. Changes to entry tickets due to user reasons will not be accepted.
- 5. If users do not receive entry tickets issued by the Company for reasons on their part, the Company will not refund the ticket price and various fees related to the application.
Article 9: Replacement, Change, Cooling-Off of Tickets
Tickets allocated to users after the announcement of winning results cannot be replaced, changed, or canceled for any reason. Additionally, tickets are exempt from cooling-off provisions.
Article 10: Ticket Refunds
Notification to users regarding changes or cancellations of performances, etc., will be made by the Company. Refunds will be made within the refund period specified by the Company, and refunds will not be processed after this period has elapsed. The refund amount will be limited to the face value of the ticket, and no other expenses (transaction fees, application fees, transportation expenses, accommodation expenses, communication fees, delivery fees, transfer fees, etc.) will be reimbursed.
Article 11: Ticket Reissuance
Tickets will not be reissued under any circumstances (such as loss, theft, or damage).
Article 12: Prohibition of Resale
Except as permitted by the Company, resale of tickets purchased from the Company to third parties, whether for a fee or free of charge and regardless of the reason, is prohibited. Any use or resale of tickets by accompanying persons that does not comply with the methods specified by the Company is also prohibited. Attempting to resell tickets through ticket resale sites or internet ticket auctions is also prohibited. If such actions are discovered, the Company or the event organizer may invalidate the purchased tickets at their discretion, refuse ticket refunds, and deny entry. Individuals may also be instructed to leave if they are already inside the venue. Additionally, the Company bears no responsibility for any issues related to tickets purchased from sources other than the Company, such as "ticket shops," "purchasing agents," or "ticket scalpers."
Article 13: Prohibited Activities
Users are prohibited from engaging in the following activities when using the Service:
- 1. Actions that infringe upon the copyrights, property rights, privacy, or other rights of other users, third parties, or the Company, or actions that may infringe upon them.
- 2. Actions that disadvantage or cause harm to other users, third parties, or the Company, or actions that may cause such disadvantage or harm.
- 3. Defamation or slander against other users, third parties, or the Company.
- 4. Actions that violate public order and morals, or actions that provide information contrary to public order and morals to other users or third parties.
- 5. Criminal acts or acts associated with criminal activities, or actions that may lead to such acts.
- 6. Election campaigns or similar activities, regardless of whether it is an election period or not.
- 7. Activities related to sexual services, religion, or politics.
- 8. Profit-making activities or preparations for profit-making activities through the Service or related to the Service without the Company's approval.
- 9. Using or providing harmful programs such as computer viruses through the Service or related to the Service without the Company's approval.
- 10. Acts that violate laws or may violate laws.
Article 14: Suspension or Interruption of Service
- 1. The Company may suspend or interrupt the operation of the Service under the following circumstances:
- (1) Regular or emergency maintenance of the Service system.
- (2) Occurrence of emergencies such as war, riots, disturbances, labor disputes, earthquakes, eruptions, floods, tsunamis, fires, blackouts, or other emergencies that make it impossible to provide the Service as usual.
- (3) Other situations where the Company deems temporary interruption necessary for the operation of the Service.
- 2. The Company shall not be liable to users for the suspension or interruption of the Service based on the preceding paragraph.
Article 15 (Disclaimer)
- 1. Except where attributable to reasons for which the Company is responsible, the Company shall not be liable for any damages incurred by users or third parties arising from the provision, delay, alteration, cessation, suspension, or abolition of various information related to the Service or any other matters associated with the Service. In cases where damages incurred by users are attributable to reasons for which the Company is responsible, the Company's liability for damages shall be limited to the purchase price of the relevant ticket. However, in cases where the Company acts intentionally or with gross negligence, this limitation shall not apply. Additionally, the use of the Service shall be entirely at the user's own risk.
- 2. The Company and its affiliated companies shall encrypt and strictly manage personal information registered by users for the use of the Service, and shall take sufficient care to maintain confidentiality. However, as there are limitations to maintaining complete security on the Internet, users acknowledge that the Company cannot guarantee the complete protection of their privacy and agree to use the Service accordingly.
- 3. The Company and its partner companies do not guarantee the safety, accuracy, reliability, usefulness, timeliness, legality, or morality of the information or services provided on the Site or through emails sent by partner companies. Therefore, the Company shall not be liable for any damages incurred by users or third parties in connection with the information or services provided by the Company or obtained by users through the methods mentioned above.
- 4. The Company shall not be responsible for any information, services, etc., contained in other websites linked from the Site. Users are advised to use linked websites in accordance with the terms and conditions set forth by those websites, at their own risk.
Article 16 (Outsourcing to Third Parties)
The Company may outsource all or part of the business related to the Service to third parties.
Article 17 (Exclusion of Anti-Social Forces)
- 1. Users guarantee that they do not fall under any of the following categories: organized crime groups, members of organized crime groups, individuals who have not yet elapsed five years since ceasing to be members of organized crime groups, organized crime-related companies, or others equivalent to these, as stipulated by laws and regulations concerning the exclusion of anti-social forces in the prefecture where their headquarters, branches, or other main offices are located.
- 2. Users guarantee that they do not engage in threatening behavior, the use of violence, hindrance of business by deception or coercion, defamation of trust, unreasonable demands beyond legal responsibilities, or any other acts similar to these, either by themselves or through third parties, while registered as users.
- 3. In the event that the Company determines that a user has violated the guarantees in the preceding paragraphs, the Company may cancel the user's TOBE ID registration without notice, and the Company shall not be liable to compensate the user for any damages resulting from such cancellation. However, if the Company incurs damages due to such cancellation, the user shall compensate the Company for all such damages.
Article 18 (Handling of Violations of these Terms of Use)
- 1. If a user is found to have violated these Terms of Use (including associated agreements), or if the Company deems it necessary, the Company may take measures deemed necessary, including but not limited to the following, against such user. Even if the user suffers disadvantages or damages as a result of these measures, the Company shall not be liable.
- (1) Immediate cessation of acts violating these Terms of Use and a request not to repeat similar acts.
- (2) Disclosure of information related to violations, including reporting to the police or other public authorities if there is a possibility of criminal or administrative proceedings.
- (3) Suspension of all or part of the use of other services provided by the Company, including the Service.
- (4) Imposition of measures such as suspension of membership or forced withdrawal from fan clubs or other services provided by the Company, to which the user is subscribed.
- 2. The Company may refuse to provide the Service to users who have undergone the measures in the preceding paragraph in the future (including refusal to provide the Service and forced withdrawal from other services already registered). Additionally, the Company may retain personal information to the extent necessary for such measures.
- 3. Users shall not object to the Company's handling of violations of these Terms of Use.
- 4. Regardless of whether the Company has taken the measures specified in Paragraph 1, if the Company incurs damages due to a user's violation of these Terms of Use, the Company may claim damages from the user.
- 5. The Company shall not be liable for any consequences resulting from violations of these Terms of Use.
Article 19 (Amendments)
- 1. If the Company determines that there are sufficient reasons, the Company may amend these Terms of Use at any time without obtaining prior consent from users, as long as the amendments do not contradict the purpose of the agreement and are reasonable considering the necessity of the amendments and the appropriateness of the contents after the amendments. The Company will publish the amended Terms of Use on the Service in advance.
- 2. In addition to the preceding clause, the Company may, if it satisfies the requirements stipulated in Article 548-4, Paragraph 1 and Paragraph 2 of the Civil Code, make changes to these Terms of Use based on the provisions of the said article.
- 3. If a user does not agree to the amendments to these Terms of Use, they should stop using the Service.
- 4. Once the amendments to these Terms of Use take effect, if a user uses the Service, it will be deemed that the user has agreed to the amended Terms of Use.
Article 20 (Validity of these Terms of Use)
- 1. Even if all or part of the provisions of these Terms of Use are deemed invalid based on laws and regulations, the remaining parts of those provisions and other provisions of these Terms of Use shall remain valid.
- 2. Even if part of these Terms of Use is deemed invalid or rescinded in relation to a specific user, these Terms of Use, including the part in question, shall remain valid in relation to other users.
Article 21 (Governing Law and Jurisdiction)
- 1. These Terms of Use shall be governed by and interpreted in accordance with Japanese law.
- 2. Any disputes relating to these Terms of Use shall be exclusively submitted to the Tokyo District Court or the Tokyo Summary Court as the court of first instance with exclusive jurisdiction by agreement between the parties.
